Terms of service

These terms govern the use of Blomqvist Screener (the “Service”) at blomqvistscreener.com. The Service is provided by Melker Blomqvist, Entrepreneur individuel (EI), micro-entrepreneur, trading as Blomqvist Enterprise, 73 avenue du 3 Septembre, 06320 Cap-d’Ail, France (“we”, “us”). By creating an account or subscribing, you accept these terms and our privacy policy.

1. Who the Service is for

The Service is a business tool for professionals such as investors, M&A advisers, search funds and their teams. By accepting these terms you confirm that you use it for purposes related to your trade, business or profession, and that you have authority to accept these terms on behalf of the business you work for, if any. The Service is not offered to consumers.

2. What the Service provides

The Service lets you search, filter, save and export information about companies that is published in official company registers and open data sources, including Companies House (United Kingdom), Bolagsverket and Statistics Sweden (Sweden) and INSEE’s Sirene register (France). Some fields are derived by us, for example sector groups, size bands, peer comparisons and revenue estimates. Derived and estimated figures are labelled as such.

Register data can be incomplete, out of date or wrong, and we reproduce it as published. Estimates are statistical approximations, not facts about a company. Nothing in the Service is investment, legal, tax or financial advice. You are responsible for checking information against the official register and other sources before relying on it.

3. Your account

• Each account is for one named person. Do not share your login or let several people use one account.
• Keep your password secure and tell us promptly if you think your account has been used without permission.
• The information you give us, including your email address, must be accurate.

4. Plans and prices

The free plan shows the first 25 results of a search and includes 1 list and 1 saved search. Paid plans are Starter at €49 and Pro at €129 per month. Each plan’s features are described on the pricing section of the site at the time you subscribe.

Prices are in euros. VAT not applicable, article 293 B of the French General Tax Code (TVA non applicable, art. 293 B du CGI). The founding member price of €29 per month for Starter is available to the first 20 customers and stays the same for as long as that subscription remains active without interruption.

We may change prices for future billing periods. We will tell you by email at least 30 days before a change applies to your subscription, and you can cancel before it takes effect.

5. Payment, renewal and cancellation

• Paid plans are billed monthly in advance through our payment provider Stripe. Your card details are handled by Stripe and are never stored by us.
• Subscriptions renew automatically each month until cancelled.
• You can cancel at any time from the billing page. Cancellation takes effect at the end of the current billing period, and you keep access until then. Periods already started are not refunded, except where the law requires it.
• If a payment fails and is not resolved, your account returns to the free plan. Your lists and saved searches are kept within the free plan’s limits.
• Invoices and receipts are issued by Stripe on our behalf and sent to the email address on your account.

6. How you may use the data

You may use the Service and the data you export from it for your own internal business purposes, for example to research, shortlist and contact companies.

You may not:

• resell, sublicense or publish exported data, or use it to build a database, product or service that competes with the Service;
• scrape, crawl or extract data from the Service by automated means, or bypass the limits of your plan;
• use the Service in breach of the law, including data protection and direct-marketing rules when you contact people at the companies you find;
• try to access other users’ data, disrupt the Service or probe it for weaknesses.

Register data remains subject to the licences of its sources, which require attribution: the Open Government Licence v3.0 (Companies House, Crown Copyright), the Licence Ouverte / Open Licence 2.0 (INSEE) and the terms of Bolagsverket’s open data. When you publish anything based on that data, credit the original source.

7. Our rights in the Service

The software, design, sector classifications, derived figures and the way the data is compiled and organised belong to us. These terms give you a right to use the Service during your subscription, not ownership of any part of it.

8. Availability and changes

We aim to keep the Service available and the data refreshed as described on the site, but we do not guarantee uninterrupted access. We may carry out maintenance, and we may change, add or remove features. If we remove a feature that is central to a paid plan, you may cancel and we will refund the unused part of the current period.

9. Liability

We provide the Service with reasonable care. To the extent the law allows, we are not liable for indirect losses such as lost profits, lost opportunities or lost data, or for losses caused by errors or gaps in register data, estimates or third-party services. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law, including for fraud or gross negligence.

10. Suspension and termination

We may suspend or close an account that breaches these terms, after notice where practical. You can stop using the Service and ask us to delete your account at any time by writing to help.blomqvistscreener@gmail.com.

11. Changes to these terms

We may update these terms. We will tell you by email or in the Service at least 30 days before material changes take effect. If you keep using the Service after that, the new terms apply. If you do not agree, you can cancel before they take effect.

12. Law and disputes

These terms are governed by French law. Before going to court, please contact us so we can try to resolve the matter. Any dispute between professionals that cannot be settled amicably falls under the exclusive jurisdiction of the courts of Nice, France. The English version of these terms is the reference version.
